Lawrence v. Texas
Decided: 2003
In brief
Struck down state sodomy laws, overruling Bowers and establishing constitutional protection for private, consensual intimate conduct.
The Court's ruling in depth
The Court, in Justice Kennedy's opinion, expressly overruled Bowers: adults have a liberty interest under the Due Process Clause in intimate conduct without government intrusion. 'The State cannot demean their existence or control their destiny by making their private sexual conduct a crime.' Lawrence transformed the constitutional status of gay people and set the doctrinal foundation for marriage equality.
