Kennedy v. Bremerton School District
Decided: 2022
In brief
Upheld a public school coach's right to pray on the field after games, narrowing the Lemon test's role.
The Court's ruling in depth
A high-school football coach was disciplined for kneeling in silent prayer at midfield after games. The Court ruled for the coach and declared that Lemon and its 'endorsement test' had 'long ago' been abandoned in favor of an approach anchored in 'historical practices and understandings.' Kennedy is the doctrinal centerpiece of the current Court's Establishment Clause revolution.
